1. Acceptance of Terms

Welcome to FCLive, operated by Bloinka LLC (“we,” “our,” or “us”). By accessing or using the FCLive website, mobile application, and related services (collectively, the “Service”), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service.

2. Intellectual Property and Content Ownership

All content on the Service, including but not limited to event listings, event descriptions, curated schedules, photographs, graphics, text, data compilations, software, and the selection and arrangement thereof (collectively, “Content”), is the property of Bloinka LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

The compilation, organization, and presentation of event listings and related information on FCLive constitutes a copyrightable work and/or a protected database under applicable law. The creative effort involved in researching, curating, verifying, organizing, and presenting event information represents original work protected by copyright.

3. Prohibited Uses

You agree not to, and you will not permit any third party to:

• Scrape, crawl, or harvest Content from the Service using automated tools, bots, spiders, scrapers, or any other automated means, whether for commercial or non-commercial purposes
• Copy, reproduce, republish, or redistribute any Content from the Service, including event listings, in whole or in substantial part, on any other website, app, publication, or platform without prior written consent from Bloinka LLC
• Create derivative works based on our Content, including compiling, repackaging, or reformatting our event listings for distribution or display
• Systematically download or store Content for the purpose of creating or compiling a competing collection, database, or directory of events
• Frame, mirror, or embed any portion of the Service without prior written authorization
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed on or within the Service
• Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service
• Access the Service through any automated means (including use of scripts or web crawlers) other than through our publicly available interfaces

4. Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only. This license does not include the right to collect, aggregate, copy, duplicate, display, or make derivative use of the Service or any Content, nor any right to data mine, scrape, or use robots or similar data gathering tools.

Any use of the Service beyond the scope of this limited license, without prior written permission of Bloinka LLC, is strictly prohibited and will result in the termination of the license granted herein.

5. Digital Millennium Copyright Act (DMCA)

We respect intellectual property rights and expect our users to do the same. If you believe that Content on the Service infringes your copyright, please send a DMCA takedown notice to our designated agent at [email protected] with the following information:

• A description of the copyrighted work you claim has been infringed
• The URL or location on our Service where the allegedly infringing material is located
• Your contact information (name, address, phone, email)
• A statement that you have a good faith belief the use is not authorized by the copyright owner
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
• Your physical or electronic signature

Conversely, Bloinka LLC reserves the right to pursue DMCA takedown notices and all available legal remedies against any party that copies, reproduces, or redistributes our Content without authorization.

6. Enforcement and Remedies

Any unauthorized use of Content from the Service may violate copyright laws, trademark laws, privacy and publicity laws, computer fraud and abuse statutes, and communications regulations. Bloinka LLC actively monitors for unauthorized use of its Content and will pursue all available legal remedies, including but not limited to:

• Injunctive relief to prevent further infringement
• Statutory and actual damages under applicable copyright law
• Recovery of attorney's fees and costs
• DMCA takedown notices to hosting providers and platforms
• Reporting violations to search engines for removal from search results

7. User Submissions

If you submit event information, corrections, or other content to us through the Service, you grant Bloinka LLC a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, and display such submissions in connection with the Service.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind. While we strive to keep event information accurate and up to date, we do not guarantee the accuracy, completeness, or reliability of any Content. Event details including dates, times, and locations are subject to change by event organizers without notice.

9. Limitation of Liability

To the fullest extent permitted by law, Bloinka LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Florida.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
